Not being a lawyer, I’m not really qualified to make a judgment here, but I’m not entirely certain that that perspective will stand up to scrutiny under law, nor am I aware of any case where this particular angle of emulation was explicitly examined.

By their analysis, it’s legal for you to rip your own CD to your drive, but it’s not legal for you to, say, take your brother’s rip of another copy of the same CD to save time. Nintendo, at least, says that it is not legal because the copy you are downloading is an infringing copy. (Item in quotes because it’s data, or IP or whatever, not a physical object)

So, I guess is acquiring the “item” a different criminal act from possessing the “item”? downloading a bit-wise identical version of it? if you have the rights to a game or piece of music (cartridge or CD), is there a legal difference between ripping that yourself vs.
